Chosen Charities Terms and Conditions
1. Introduction
1.1 We are pleased to announce that Drake Circus Centre Limited (“we”, “us” our”) are inviting applications from local charities to be one of our charity partners for our 2018/2019 financial year.
1.2 Our chosen charity partners will work with us over our financial year in relation to fundraising activities.
2. How to apply
2.1 The application window will be open from 08:00 on Wednesday 20th February (the “Opening Date”) to 23:59 on Wednesday 6th March (the “Closing Date”) inclusive.
2.2 You must enter your application by emailing a one pager with the following information to [email protected] by the Closing Date:
- Name of organisation/charity
- Charity registration number
- Description of your organisation
- Examples of previous fundraising events (photos optional)
- Ideas for fundraising events when working with us
- Contact information
All applications must be received by us by no later than the Closing Date.
2.3 To be eligible to apply, you must meet the criteria in condition 3 (Who can apply).
3. Who can apply
3.1 We will consider your application if you are a charitable or community organisation with a presence in the local area around the Drake Circus Shopping Centre (as determined by us) and meet the following requirements:
(a) You are a registered charity (UK or Scotland), Company Limited by Guarantee, Community Interest Company, Social Enterprise, Voluntary Organisation or educational institution;
(b) You must not be a political organisation or an organisation that promotes a specific religion. However, faith-based bodies that are supporting charitable or community causes are acceptable;
(c) You must not discriminate on the basis of gender, race, colour, disability, sexual orientation or religious belief;
(d) 100% of any funds raised in connection with us must be directed to a charitable or community cause; and
(e) There must not be a conflict of interest, as determined by us (for example a significant connection between you and a member of our staff).
4. Selection
4.1 We shall select which charity partners we wish to partner with in our absolute discretion.
4.2 All applicants will be notified of the outcome via email by Monday 25th March. Our decision is final, and no correspondence shall be entered into.
5. General terms
5.1 By submitting an application, you are agreeing to be bound by these terms and conditions.
5.2 We will not accept:
(a) responsibility for applications which are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any postal failure, equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind; or
(b) proof of posting or transmission as proof of receipt of application.
5.3 Insofar as is permitted by law, we and our agents and distributors will not in any circumstances be responsible or liable to compensate any applicant or accept any liability for any loss, damage, personal injury or death occurring as a result of the application process or the acceptance of an application, except where it is caused by our negligence or the negligence of our agents or distributors or that of our or their employees. Your statutory rights are not affected.
5.4 You agree that we may, but are not required to, make your entry available on our website and any other media, whether now known or invented in the future, and in connection with any publicity of the application process. You agree to grant us a non-exclusive, worldwide, irrevocable licence, for the full period of any intellectual property rights in the application and any accompanying materials, to use, display, publish, transmit, copy, edit, alter, store, re-format and sub-licence the application entry and any accompanying materials for such purposes.
5.5 We will only process your personal information as set out in the privacy notice (https://www.britishland.com/site-services/privacy-notice).
5.6 If there is any reason to believe that there has been a breach of these terms and conditions, we may, in our sole discretion, reserve the right to exclude you from participating in the application process.
5.7 We reserve the right to hold void, suspend, cancel, or amend the application process where we believe it is necessary to do so.
5.8 These terms and conditions constitute the entire agreement between us and you.
5.9 These terms and conditions shall be governed by English law, and the parties submit to the exclusive jurisdiction of the courts of England and Wales.
